Project Dune (“Dune”, “the Service”) is a campaign command centre for media planning, delivery and reconciliation, provided by Meridian Systems LLC FZCO(“we”, “us”). These terms govern access to and use of the Service by organisations that subscribe to it (“Customers”) and by the people they invite to use it (“Users”), including client viewers of the portal.
By signing in or using the Service you agree to these terms on your own behalf and, where you act for an organisation, on its behalf. If you do not agree, do not use the Service.
Accounts are provisioned by invitation only. Each account is for one named person; credentials must not be shared. You are responsible for activity under your account and must tell us promptly at the address below if you believe it has been compromised.
Customers control who in their organisation, and which of their clients, may access their data, and may suspend or remove access at any time. Access ends when a Customer deactivates a User or when the Customer’s subscription ends.
You must not, and must not allow anyone else to:
Plans, bookings, invoices, performance data, documents and other content a Customer or its clients put into the Service (“Customer Data”) remain the Customer’s. We process Customer Data only to provide, secure and improve the Service, and as described in our Privacy Policy. Customers are responsible for having the rights to the data they upload and for their clients’ use of the portal.
Each Customer’s data is isolated from every other Customer’s. Client viewers see only the campaigns and figures the Customer chooses to disclose to them.
Each party will keep the other’s non-public information confidential and use it only for the purposes of the Service, except where disclosure is required by law. This survives the end of the relationship.
Fees, billing periods and payment terms are set out in the Customer’s order or subscription agreement. Unless that agreement says otherwise, fees are payable in advance, are exclusive of applicable taxes, and are non-refundable.
The Service, its software, design and documentation are ours or our licensors’ and are protected by intellectual-property law. We grant Customers and their Users a limited, non-exclusive, non-transferable right to use the Service during the subscription in accordance with these terms. Feedback you give us may be used without obligation.
We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may update, add to or remove features, and will give reasonable notice of changes that materially reduce functionality. Support is provided by email during business hours in the United Arab Emirates.
The Service connects to third-party platforms (for example advertising and analytics platforms) at the Customer’s request. Use of those platforms is subject to their own terms, and we are not responsible for their availability or the data they return.
The Service is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties, and our total liability arising out of or in connection with the Service in any twelve-month period is limited to the fees paid by the Customer for that period. Neither party is liable for indirect or consequential loss, loss of profit, or loss of data, except where liability cannot be limited by law. Nothing limits liability for fraud, death or personal injury caused by negligence.
Figures shown in the Service are derived from the data supplied to it; the Customer remains responsible for verifying anything on which it relies commercially.
We may suspend access where there is a security risk, a breach of these terms, or unpaid fees, and will restore it once the issue is resolved. Either party may terminate the subscription as set out in the Customer’s agreement. On termination Customers may export their data using the Service’s export tools; thereafter data is retained and deleted as described in the Privacy Policy.
These terms are governed by the laws of the United Arab Emirates, and the courts of the United Arab Emirateshave exclusive jurisdiction over any dispute arising from them, without prejudice to any dispute resolution terms in the Customer’s agreement.
We may update these terms from time to time. The date at the top shows the current version; material changes will be notified to Customers in the Service or by email before they take effect. Continued use after that date is acceptance of the updated terms.
